Your use of this site and our services is subject to the following terms and conditions.
When tickets are purchased electronically online (e-tickets), the customer must bring their confirmation email including unique reference number to the event to gain entry. AM Gigs may request that further proof of identification be also provided.
When physical tickets are being collected at the box office, we ask that the cardholder presents the card that the tickets were booked on as identification. Any other forms of identification or letters of authorization are taken at your own risk and may result in the tickets being withheld at the box office.
In the event that your tickets are lost in the post and duplicates are arranged for collection at the box office, these will only be given out to the cardholder upon production of the card that was used to make the booking.
Once purchased, tickets cannot be transferred, exchanged, refunded or returned unless the event is cancelled, moved to another date, or if details of the event are significantly changed after an order is placed (significant changes being a change of headline act (concerts only), venue or show time).
In the event of the cancellation of an event due to circumstances beyond AM Gigs's control, AM Gigs will only refund the face value of the ticket. AM Gigs will use best endeavours to contact purchasers either by phone, email or in writing (using the details provided at the time of ordering) and advise them to return the tickets. Please note, however, it is the customer's responsibility to check whether the event is going ahead at the scheduled date, time and venue, and AM Gigs cannot guarantee that they will inform the customer of any changes to the event date, time or venue.
We advise the use of secure mail when returning tickets. On receipt, AM Gigs will refund the customer the face value of the tickets using the same method as used to purchase them.
If an event is moved from its advertised venue and / or the date is changed, tickets already purchased may remain valid should the customer wish to attend the revised event. If not, AM Gigs will refund the face value of the tickets. AM Gigs will notify all purchasers by phone, email or in writing (using the details provided at the time of ordering) to advise on the validity of the tickets and the procedure for obtaining a refund. Refund requests will usually be accepted up until 1 week prior to the revised event, or 3 days after notification of the change (whichever is the later) unless otherwise notified. In the event of a change at short notice (within 1 week of the event) AM Gigs will notify purchasers of the conditions that apply, and offer a refund if these are not agreeable. Please note, however, it is the customer's responsibility to check whether the event is going ahead at the scheduled date, time and venue, and AM Gigs cannot guarantee that they will inform the customer of any changes to the event date, time or venue.
Should the headline artist not appear or if the line up or content is substantially changed from the advertised line up or content (concerts only), then AM Gigs will refund the face value of the tickets.
If AM Gigs is unable to fulfil an order for any of the reasons below the customer will be entitled to a full refund, including any booking fee charged:
AM Gigs despatch your order to the wrong address and cannot provide replacement tickets
AM Gigs do not despatch your order and do not arrange for the tickets to be available for collection
AM Gigs despatch the wrong order, ie wrong event / wrong type of tickets
Any other similar circumstances where AM Gigs has acted with negligence or where we may have acted in breach of contract
No duplicate tickets will be issued to replace lost or stolen tickets.
Customers are advised to check their purchase upon receipt.
It is the responsibility of the customer to inform AM Gigs of any change of address, contact phone number or email address, both before and after receipt of the goods. Please note that our preferred method of contact for customers booking online is by email, so care should be taken to provide a current, valid email address.
The right to admission to an event is reserved by the promoter and event venue, who may take health and safety, environmental and security concerns into account at their reasonable discretion, and may from time to time carry out security searches. AM Gigs would advise customers that no refunds will be offered to customers who are refused entry or ejected from a venue on account of late arrival, being (or appearing to be) under age*, declining to be searched, abusive, threatening, drunken or other antisocial behaviour (including smoking in no smoking areas), carrying offensive weapons or illegal substances, or making unauthorised audio, video or photographic recordings.
* Events and ticket types where an age restriction applies are clearly indicated during the booking process. Please ensure that you read all the information that applies to the event/ticket you are booking, and carry proof of age if appropriate.
If it becomes impractical to post tickets out, due to the proximity of an event or circumstances beyond our control, we reserve the right to make tickets available for collection at the venue immediately prior to the event. Customers will be notified by phone, email or in writing (using the details provided at the time of ordering) if this becomes necessary.
By ordering you agree that the tickets are for the personal use of you and your party only, and will not be resold or transferred. Any resale or attempt to resell the tickets at a price higher than purchased will result in your orders being cancelled without prior notification.
If a customer orders more tickets than the maximum allowed, as indicated during the booking process, we reserve the right to cancel the order. The maximum applies per person/card/household.
If tickets that are despatched are returned to AM Gigs as "addressee unknown", we reserve the right to cancel the order.
In order to prevent fraud and to protect both parties, you may be asked to provide additional information after your booking so that we can verify your purchase.
We reserve the right to cancel any order that further to investigation we deem to be possibly of a fraudulent nature. These checks may include, but not be limited to, a request to be provided with an original credit or debit card statement, attempts to contact a customer by telephone, reference to records to check for other fraudulent activity at an address.
Applicable law
Every sale shall be deemed to be performed
in England; English law shall govern each transaction, including (without limitation)
all contractual and other relationships, which arise as a result of such
sales.
You and we submit to the non-exclusive jurisdiction of the English courts
in relation to any disputes arising out of any sale.
Making a contract with us
You agree
to purchase from AM Gigs using your correct name and address. You may
be asked to enter credit, debit or charge card details. You must ensure that
(a) you are fully entitled to use that card at the time when you provide
those details to AM Gigs, and when you use the card, and b) the card
has available
funds to cover all charges incurred on it in the course of buying from us.
If any of the information you enter becomes incorrect or is superseded, then
please notify us with the corrected information immediately.
In any event, to register for AM Gigs services, you must legally be
able to enter into contracts for goods and services that you may buy here.
Generally,
this means that you must be at least 18 years old.
Copyright
You accept that the images and designs used on the AM Gigs
website
are the
property of AM Gigs or their respective copyright owners, and are used
by AM Gigs pursuant to express authorisation from copyright owners
or their agents. You acknowledge that all copyright, trademarks and other
intellectual
property rights in and relating to AM Gigs are vested in AM Gigs
or our partners where appropriate. You must not use, reproduce, modify or
distribute our images or any part of those images in any manner, whatsoever.
Not only
will this make us throw our toys around, but in the event that there is
any dispute between us in relation to this issue, you agree that until the
matter
is resolved, an interim injunction will be an appropriate remedy. An Interim
injunction is a court order, which would prevent any further use or distribution
of the image that we are concerned about, until a final court hearing where
the court will make a decision on all the facts.
Loss
Be aware that we will
not be liable to you or any third party for any indirect or loss or damage,
or
for any loss of data, profit, revenue, business or management time, howsoever
caused.
You also agree that the liability of AM Gigs under this agreement (whether
arising in negligence or otherwise), will not under any circumstances exceed
the greater of a) £20 or b) an amount equal to the sums paid or payable
by you.
This does not affect your statutory rights as a consumer.
Consequential Loss
In the event of consequential loss, AM Gigs can only be responsible
for the cost of your order.
Negligence
Although we couldn't think of any way this could possibly happen, we thought
we should state that nothing in this agreement limits AM Gigs’ liability
for personal injury or death resulting from our negligence.
Reasonable Control
AM Gigs shall not be liable for any failure to perform its obligations
under this agreement if caused by matters beyond our reasonable control.
Changes to this Agreement
AM Gigs reserves the right to change the terms of
this agreement
from time to time, and post a new version on our website. The new version
will take effect from the day of posting on the site. Price and availability
information
are also subject to change without notice.
Severability
In the event that any term of this agreement is held to be unenforceable
or invalid by judicial decree or decision, the remainder of this agreement
shall
remain valid and enforceable.
Security and Privacy
We know you're concerned about security and privacy. We want to reassure
you that any information you give us during the ordering process as well
as any
that we know about you by other means will be well protected. We also feel
it is important that you know exactly how any information you give us is
used and that all information is collected lawfully and in accordance with
the Data
Protection Act 1998.
How we use your data
The privacy policy forms part of the agreement between us, and by purchasing
goods from our site, you agree to be bound by the terms and conditions of
the agreement between us. You also give your consent to the way we may handle
your
personal data in the way stated in this policy statement. AM Gigs will
not use this data, or disclose it to any other party, without your express
permission.
We may also contact you in respect of special offers or competitions, but
only if you have elected to receive this by checking the opt-in box during
the purchase
procedure. You may unsubscribe from our contact list at any time by replying
to a promotional email with the word “unsubscribe” in the subject
line or by e-mailing us at adam@amgigs.co.uk.
To provide a service that meets our customer needs, we may collect personal
data relating to the popularity and usage of particular aspects of the site
or related AM Gigs sites. However this data will be used or aggregated
only on an anonymous basis.
